These terms apply to website, ecommerce and marketing services provided by Rise Web Design ("we", "us"). Your quote sets out the specific work, price and timeline for your project, and forms part of these terms. By accepting a quote, you agree to these terms.
Quotes & Payment
All prices are in Australian dollars and exclude GST unless stated. Payment terms are set out in your quote and invoices. We may pause work, or suspend hosting and ongoing services, if invoices remain unpaid.
Monthly Plans
Our monthly plans cover the design and build of your website plus the ongoing services listed in your plan, such as hosting, Google Business Profile management, and updates and support. Monthly plans run on a 6-month minimum term. After that they continue month to month and can be cancelled with written notice. You own the website either way.
One-Off Builds
One-off builds are paid for as a project rather than monthly. Hosting, maintenance and ongoing management are optional extras and aren't included unless they're listed in your quote.
Shopify Stores
Shopify stores are set up in a Shopify account in your name. Your Shopify subscription, and any paid apps or themes, are billed by Shopify directly to you and are separate from our fees. You own your store account, products, orders, customer data and domain, but the store runs on Shopify's platform and is subject to Shopify's own terms.
Advertising Services
For Meta and Google Ads management, ad spend is paid by you directly to the platform and is separate from our management fee. We'll always work to get the best results from your budget, but we can't guarantee a specific number of leads, sales or rankings, as these depend on factors outside our control.
Your Content
You're responsible for supplying content such as text, photos, logos and product details, and for making sure you have the right to use it. Project timelines depend on receiving content and feedback on time.
Ownership
Once your project is paid in full, the website design and content we create for you belong to you. We may show the finished work in our portfolio and on social media unless you ask us not to. Third-party themes, plugins, apps and fonts remain subject to their own licences.
Changes to Scope
Small updates are covered by monthly plans as described in your plan. Larger changes or new features outside the agreed scope will be quoted separately before any extra work starts.
Liability
Nothing in these terms excludes your rights under the Australian Consumer Law. To the extent the law allows, we're not liable for indirect losses such as lost profits, or for outages or issues caused by third-party platforms, hosting providers or services outside our control.
Governing Law
These terms are governed by the laws of Western Australia.
